Workplace Discrimination and Types
The above case discusses about the workplace discrimination that appears in organization in the name of promoting or protecting certain groups or the reservation system and its long term impacts and its adverse effects that may happen in an organization. In this case the company is bound to recruit the black employees as per the government restriction and can’t go beyond its provision. The black employees have been intentionally made back and are deprived of promotions opportunities. Thus, in my view disparate treatment has occurred in the Xerox Company. The company should act as an equal opportunity provider in all regards which is the major challenge for any organizations in today’s real world too.
Burden of Proof
The plaintiffs have the burden of proof in this case. As, the company has made a kind of restrictions/barriers to the black employees in the name of decreasing the large no. of black employees working with it. The case has clearly has clearly said that, the company has not promoted to black employees though they were as capable as the white ones.
Xerox Company in my view will not be able at defending its actions. The company has a big challenge to prove how and why the black employees are restricted for the promotions as they are equally competent to the whites. Thus, in my view, the company will really not be able to prove that they have provided the equal opportunities to the all employees working with it.
Views on Avoiding Workplace Discrimination
We know that workplace discrimination is a serious problem with no easy solution. The easiest way of avoiding the employee discrimination is using the simple techniques during job search by the employers and the employees both. If we carefully search our jobs, then major reason of discrimination is solved automatically. Xerox Company should make all the employees clear about the company’s policies and the provisions for any kind of internal competitions. The company can prepare a detailed plans and long term vision related to its HR requirement and the specific qualifications and competencies required.
