In this example, P.A. is suing International Widgets, Inc. for breach of contract. P.A. Kettle was enticed by Brigitte Godot, a sales person for International Widgets, Inc., to purchase $20,000 in widgets for his company. Brigitte Godot enticed P.A.Kettle to purchase those widgets within 24 hours and promised him he would receive a free trip to Paris. In the written agreement that P.A. signed, it said nothing of the free trip to Paris. P.A. Kettle called to get his free trip and was only awarded a bus ticket to Paris, Texas. Clearly P.A. Kettle and Brigitte Godot were not discussing a trip to Paris, Texas. If a reward for signing a contract within 24 hours is made, it would be for a trip to Paris, France. After complaining to International Widgets, Inc., Brigitte Godot was fired, but the company is not standing by Ms. Godot's promise. Could this be a practice in which the Federal Trade Corporation Act would cover because of the unfair and deceptive practices? Can P.A. Kettle prove he was intentionally misled with a trip to Paris, France into signing a contract with International Widgets, Inc.? Can International Widgets, Inc. prove they had no knowledge of Brigitte Godot's sales practices and rectified the situation by firing her? Can International Widgets, Inc. prove the promise of the trip to Paris is not their responsibility since it is not in the written contract P.A. Kettle signed? These questions need to be answered in order to find out which side to rule on.
