Scenario 1: An employer has no beard policy, which applies across the board to all employees. A black employee tells the employer he cannot shave without getting severe facial bumps from ingrown hair. The employer replies that the policy is without exception and the employee must comply. The employee refuses and later is terminated. The employee bring suit under Title VII on the basis of race discrimination. Does he win? Why or Why not?

An employer has the right to make guidelines and rules that have may affect the business. The man in this scenario worked for Dominoes as a delivery man, delivering pizza which deals with customers. The customers perceptions of the delivery person directly affects the business, because if the driver appearance is less than satisfactory can impact delivery business, which is probably the hub of the Domino's pizza business. Dominoes are in the business of satisfying the customer by delivering quality product in an efficient time. The employer is not taking an interest in a problem that the driver has that can affect business because the workplace can be hostile because the employee conditions are not being empathy. The employer maybe in this case feels that the condition is not a big deal or maybe does not affect the employee as the employee states. Some, stereotypes that men of color carry around is that lazy, not hard working , does anything to get out of working or just stupid does not understand the business world (9 Stereotypes of Black Men, 2011) . The employer can have the perception that the employee is just trying to get out of being responsible by abiding the rules of shaving his beard.

The employer is not directly making a discriminating statement but also not acknowledging the fact that his employee is protected under Title VII. The employee should not discriminate based on his color or race; the employer might feel that his other employees of other races are not complaining about the guidelines that the employee issues are not an issue that needs to be dealt with. The fact remains the employer did not take the employee's condition to be real, but the condition is called Pseudo folliculitis Barbae. The condition occurs in the beard area, this condition affects 60% of African American men and other people with curly hair (American Osteopathic College, 2013). The problems results when highly curved hairs grow back into the skin causing inflammation and foreign body reaction.
