The punishment that would be issued to Jim would be decided by a judge in a court setting. The outcome with regards to the crime can land Jim in jail or on house arrest, simply because this is not his first offence.

The theories in the 21st century pertain to the statues of each individual state that issues a sentencing to a person when they commit a crime and is based on factual information.
Procedure:
Procedures in the 21st century are handles very effective and diligently in this century and usually does not take an enormous amount of time considering the evidence obtained.

"Diversions are not to be ignored with regards to the criminal justice system and scrutiny"(Dingwall, G., Gillespie, Alisdar, A., 2007).
Prevention
Prevention can only be achieved by properly schooling juvenile offenders of the consequences at hand.
The most significant source of correctional law is the United States Constitution and the Bill of rights. These two sources regulate the power the government has over the people and gives detail into the natural rights of every American and the limits in which the government can interfere. These also seperate what is a right and what is a privilage. The Constitution gives discription of the rights of the people that even convicted felons are intitled to. This is also true for the Bll of Rghts. These tell what the rights are of the people and the mandatory access to information, courts, media, and speach of the American people.
I think the Amendment that is most important to an incarcerated individual is the right to a speedy trial and witnesses. I think this because of a few reasons. Every individual has the right to know that their case is being heard and that they can adress issue of their case in a timely manner. Also that they can call witnesses to testify on their behalf to help either prove their innocence or wrong doing. While in prison this is a big issue and I think this is the biggest right
