New background checks on applicants
Stanley Jausneister owns BioServerSystems (BSS) which specializes in selling web server space to clients. BSS has in place special security encryption software protocols that make the server space nearly impossible for hackers to access (pg. 418). Mr. Jausneister received a call from one of his clients questioning the security of BSS; not the software but the people in charge of the software. This in turn has BSS questioning their hiring practices. BSS handles sensitive information on a host of clients one that develops vaccines for various bioterrorist weapons such as anthrax and plaque (pg. 418).
BSS will implement criminal and reference background checks for all hires. "Criminal background checks will show arrests and convictions, however, in most cases only convictions can be used against hiring". (Heneman, H.G.; Judge, T.A.; Kammeyer-Mueller, J.D., 2012) The interviewers will not inquire about or discuss any aspect of a candidates' criminal record. If a candidate asks questions about background checks, he or she should be told that a criminal background check will be conducted by another office. Once the check is completed HR will determine whether there is a substantial relationship between the conviction and the position and whether the applicant should be further considered for the position. Reference checks allow the potential employer to contact the previous employer concerning the applicants' job history. Use a form with standard questions that will collect the same information for every candidate whose references they check.
Avoiding legal issues
The EEO generally prohibits discrimination on the basis of race, color, sex, religion, national origin, age or handicap. BSS should avoid questions about organizations, clubs, societies, and lodges of which an applicant may be a member. An employer also may not ask a job applicant to answer medical questions or take a medical exam before making a job offer; however BSS can ask if the applicant can perform the job.
BSS background testing effectiveness
* Use only assessment tools that are job-related and valid, do not use assessment tools that are biased or unfair to any group of people.
* Assure all assessment tools meet EEO laws
* Avoid questions of an overly personal nature or that are considered offensive
* Do not rely solely on background checks or tests-Do have face to face interviews
