One of the most important problems with the Articles of the Confederation is that it did not have an Executive Branch to carry out laws. In 1777, there was no president to administer and implement federal laws. There was also no way to make sure that laws the Congress passed were carried out at the federal level. Not having a president to serve as commander in chief would also pose national security issues. In times of war or crisis, there would be no central leadership to command a unified armed forces. In the event of war, the governors from each of the respective states would be in charge of managing their states militia or “National Guard”
Another important problem with the Articles of the Confederation is the lack of the Judiciary Branch. Without this branch, there would be no federal body to decide or overturn unlawful laws that the Legislative Branch has passed. Without a Supreme Court, there would be no way to protect the citizens from a Legislative Branch that allowed the government to impede on citizens’ rights. A Supreme Court that functions outside of politic parties, is one of the best safe guards that we have for protecting and insuring citizens’ rights.
Yes, the Executive Branch and the Judiciary Branch were both resolved in the new Constitution. In the new Constitution, a President of the United States is elected and serves as the head of the Executive Branch and as Commander in Chief to the Armed Forces. In the Judiciary Branch under the new Constitution, Federal judiciary is headed by a Supreme Court. The Supreme Court interprets laws and rules on if laws are constitution or not.
